Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the 1Property property-management platform and related websites, applications, and services (collectively, the "Service"), operated by 1Property Group LLC ("we", "us", "our"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

1Property provides software for residential building and community management, including units and residents, maintenance, front desk and security operations, communications, surveys and voting, parking, and related features. We may add, change, or remove features at any time.

2. Eligibility & territory

The Service is offered in the United States only. You must be at least 18 years old and authorized to act for the building, association, or management company on whose behalf you use the Service.

3. Accounts & security

• You are responsible for the accuracy of the information you provide and for all activity under your account.
• Keep your credentials confidential and notify us promptly of any unauthorized use.
• Access is role-based; you must only access data you are authorized to view.

4. Acceptable use

You agree not to misuse the Service, including by: attempting to gain unauthorized access; uploading unlawful, infringing, or harmful content; sending spam or harassing communications; interfering with the Service's operation or security; reverse-engineering the Service; or using it to violate the privacy or rights of residents, staff, or third parties.

5. Customer data & data protection

You retain ownership of the data you submit ("Customer Data"). You grant us a limited license to host and process Customer Data solely to provide and improve the Service. As between you and us, the Customer (management company / association) is the controller of resident and staff personal information and 1Property Group LLC is the service provider/processor. Our handling of personal information is described in our Privacy Policy, and business customers may request our Data Processing Addendum.

6. Fees

Where the Service is provided under a paid plan, fees and billing terms are as set out in your order or agreement with us. Unless stated otherwise, fees are non-refundable.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by 1Property Group LLC and its licensors and is protected by law. These Terms grant you a non-exclusive, non-transferable right to use the Service; no other rights are granted.

8. Third-party integrations

The Service may integrate with third-party products (for example, electronic key cabinets). Your use of those products is governed by the third party's terms, and we are not responsible for third-party products or services.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, 1Property Group LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Service. Our aggregate liability will not exceed the amounts you paid for the Service in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold 1Property Group LLC harmless from claims arising out of your Customer Data, your use of the Service, or your breach of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or as required by law. Upon termination, your right to use the Service ends and Customer Data is handled per the Privacy Policy and any applicable agreement.

13. Governing law & disputes

These Terms are governed by the laws of the United States and the state in which 1Property Group LLC maintains its principal place of business, without regard to conflict-of-laws rules. The parties will attempt to resolve disputes informally first; any unresolved dispute will be subject to the exclusive jurisdiction of the state and federal courts located in that state, unless the parties agree in writing to binding arbitration.

14. Changes

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use after changes take effect constitutes acceptance.
